These Terms of Service apply to use of the HIT AND HOPE GOLFWEAR online store and to purchases made through it. By placing an order, you agree to the terms that apply at the time of your order. Mandatory consumer rights remain unaffected.

2. Products and product information

HIT AND HOPE GOLFWEAR sells golf socks, golf apparel, accessories and related golf and lifestyle products. We make reasonable efforts to present product descriptions, images, colours, materials, dimensions and availability accurately. Minor differences can occur because of screen settings, lighting, photography and normal production tolerances.

Availability can change without notice. If an ordered item becomes unavailable after an order has been placed, we will inform you and refund any amount paid for the unavailable item as required by law.

3. Prices

Prices are displayed in the currency and with the tax treatment applicable to the customer's market as configured in the store. Any shipping charge is shown separately before the order is completed. For destinations outside the European Union, including Switzerland and Liechtenstein, customs duties, import taxes or other charges may apply unless they are collected at checkout. Such charges are the customer's responsibility where applicable.

4. Orders and conclusion of contract

Product listings are invitations to place an order and do not by themselves constitute a binding offer. By completing checkout, you submit a binding order for the products in your cart.

After the order is received, you will normally receive an electronic order confirmation. The purchase contract is concluded when we expressly accept the order or dispatch the goods, whichever occurs first.

We may refuse or cancel an order where permitted by law, including where a product is unavailable, an obvious pricing or product-data error has occurred, payment cannot be processed, the order appears fraudulent or abusive, or the destination is outside the delivery regions available at checkout.

5. Payment

The payment methods currently available are shown during checkout. Depending on availability, these can include payment cards, PayPal, Shop Pay, Apple Pay, Google Pay and other methods offered through Shopify or connected payment providers. Additional terms of the relevant payment provider may apply.

6. Shipping and delivery

Orders are dispatched from Austria. Available destinations, shipping charges, free-shipping thresholds and estimated transit times are set out in our Shipping Policy and shown at checkout. Delivery estimates are not guaranteed unless expressly stated otherwise.

7. Consumer right of withdrawal

Consumers who are entitled to a statutory right of withdrawal generally have 14 days to withdraw from a distance purchase without giving a reason. Details, return instructions, refund rules and any applicable exclusions are set out in our Return and Refund Policy.

Where a statutory exception applies, the right of withdrawal can be excluded, for example for goods made to customer specifications or clearly personalised, subject to the requirements of applicable law.

8. Defective or non-conforming goods

Statutory warranty and legal guarantee rights apply. Nothing in these Terms limits mandatory rights relating to faulty, defective or non-conforming goods. Please contact info@treesmosphere.at if you receive an incorrect, damaged or defective item.

9. Product care and use

Follow the care and use instructions shown on the product, packaging or online store. Damage caused after delivery by misuse, improper care or failure to follow instructions does not create a claim for an original defect. This does not affect rights relating to defects that existed at delivery.

10. Business and wholesale enquiries

Dealer, pro-shop, retail, tournament, business, wholesale and display-stand arrangements can be subject to separate terms agreed in writing. Public consumer-store information should not be interpreted as an offer of wholesale pricing or dealer terms.

11. Discount codes and vouchers

Discount and promotional codes may be subject to stated conditions and validity periods. Unless expressly allowed, discounts cannot be combined. On a return from a discounted order, any refund is limited to the amount actually paid for the returned product, subject to statutory rights.

12. Intellectual property

HIT AND HOPE names, logos, designs, photographs, graphics, text, illustrations, product designs and other store content can be protected by trademark, copyright, design or other intellectual-property rights. They may not be copied, reproduced, modified or commercially exploited without appropriate permission, except where permitted by law.

13. Third-party services

The store is powered by Shopify and can use payment providers, shipping providers, analytics, marketing and other third-party services. The terms and privacy notices of those providers can also apply to their services.

14. Liability

We are liable in accordance with applicable law. No limitation in these Terms excludes or restricts liability where this is prohibited by law, including mandatory consumer rights and liability for intentional or grossly negligent conduct or personal injury where applicable.

15. Retention of title

Goods remain our property until the purchase price has been paid in full, to the extent permitted by law.

16. Privacy

Personal information is handled in accordance with our Privacy Policy.

17. Governing law

These Terms are governed by Austrian law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods, to the extent legally permitted. For consumers, this choice of law does not deprive them of mandatory consumer-protection rights of the country in which they habitually reside.

18. Jurisdiction

Statutory jurisdiction rules apply to consumers. For contracts with businesses, the competent court at the seller's registered office is agreed where legally permitted.

19. Changes to these Terms

The Terms applicable to an order are those valid when the contract is concluded. Later changes do not retroactively alter existing contracts unless lawfully agreed.
